In June 2022 the Federal Circuit and Family Court of Australia introduced the Critical Incident List to ensure priority is given to making appropriate arrangements for children in circumstances where no parent is available as a result of death (including homicide or suicide), critical injury or incarceration relating to family violence.
Matters on the Critical Incident List will be given priority so that arrangements can be made for children, who may be left with no biological or legal parent and are in immediate need of Court Orders, providing for their living arrangements and welfare. This commonly includes the need for urgent medical treatment and therapy.
Court Orders prioritised in these circumstances give certainty and authority to those extended family members or persons who have a significant relationship with the children, enabling the focus to be on their welfare and providing some stability as soon as possible.
